Licensing terms
EXCLUSIVE ARTWORK LICENSE AGREEMENT
- Grant of License: Nocturne Shadows ("Licensor") grants to the purchaser ("Licensee") an exclusive, perpetual, worldwide, non-transferable license to use the purchased artwork ("Work").
- Exclusivity: This Work is sold as a "1 of 1". Once purchased, Nocturne Shadows will immediately remove the Work from sale. The Licensor guarantees that this Work has not been licensed exclusively to another party before.
- Permitted Uses: The Licensee may use the Work for:
- Music Cover Art (Spotify, Apple Music, Soundcloud, etc.).
- Merchandise (T-shirts, posters, physical albums) unlimited units.
- Social Media & Promotional materials.
- Book Covers.
- Prohibited Uses:
- Resale: The Licensee may NOT resell, license, or redistribute the original digital file as a standalone asset (eg, selling it as a stock photo or NFT).
- AI Training: The Work may not be used to train Artificial Intelligence generators.
- Ownership: Nocturne Shadows retains the moral rights and copyright of the Work for portfolio and self-promotion purposes. The Licensee owns the exclusive rights to use the Work commercially as defined above.
- Delivery: Upon payment, Licensee will receive the high-resolution files without watermarks.
